Badlapur Rape Case: Akshay Shinde's Mother's Allegations and Controversy Around Police Encounter

Badlapur Rape Case
Akshay Shinde's death in police custody sparks controversy, with family alleging conspiracy, while Maharashtra police claim self-defense. The investigation is ongoing

The death of Akshay Shinde, a rape accused from Badlapur, has sparked controversy in Maharashtra, raising debates on police action, justice, and conspiracy. Shinde, accused in a children’s sexual assault case, allegedly died in a police encounter while in custody. While the government claims self-defense, Shinde’s family accuses the police and a school chairman of conspiracy, prompting calls for an inquiry into the case and concerns over the treatment of accused persons in custody.

The Incident and the Allegations

On September 23, the accused in the Badlapur sexual assault case, Akshay Shinde, was taken from Taloja jail to Badlapur by policemen for further investigation. He allegedly snatched the policemen’s gun and fired at them when they were transporting him, injuring the assistant police inspector. The police retaliated, leading to the death of Shinde. He was pronounced dead when he was taken to Kalwa Civil Hospital.

However, his mother and other family members fiercely oppose the police claims. His mother says her son would have never been capable of such acts and had appeared distressed inside the custody. She states that he has been beaten by the police and had sent a message to his family, stating that he needed money- probably a kind of bribe. She said that he would be frightened even by small things such as the bursting of crackers, so it was unlikely that he would react at all before armed police officers.

The Police Encounter and Claims of Self-Defense

The Maharashtra government and the Thane Police alleged the encounter to be one of self-defense. Their version of events claimed that Shinde was a direct threat when he, in effect, wrested the weapon from a policeman, and it would require a lethal response to ensure the safety of the escort party. And yet, on such justification, there was a good question from the accused’s mother and other relatives: how is this a man who was alleged to be incapable of violence described as overpowering a policeman and doing this action?

The case has brought forth so many questions regarding the legitimacies of police actions in custodial situations, more so where the nature of the case is sensitive, such as the children’s sexual assault case from Badlapur. The involvement of Akshay Shinde in the children’s sexual assault case from Badlapur only strengthens public scrutiny of the encounter.

Family Appeals for Justice

Shinde’s family, particularly his mother is demanding an independent probe into the circumstances that led to the murder of her son. She demands it not be an in-house affair but a formal, and transparent inquiry, placing emphasis again that the case was a well-planned conspiracy involving the police as much as the chairman of the school where Shinde worked as a sweeper. The school management had reasons to silence him, the family says, as it was the students at the very school from whom the charges of the sexual assault emerged.

Shinde’s mother lamented the loss of her son in a public declaration: “My son was afraid of simple things like crossing roads. How could he have snatched a gun and fired at the police?” She further alleged that Shinde had been compelled to write something before his death, pointing fingers at those responsible for his care.

Political Fallout and Popular Protests

The death of Akshay Shinde has snowballed into a political storm in Maharashtra with the opposition demanding an inquiry into the incident. Many politicians and activists are questioning the sequence of events and whether proper procedures were followed in what is being termed a suspicious custodial death. The seriousness of such allegations is compounded by the fact that the accused was in police custody at the time. There are strict guidelines on how those under police control must be treated.

Conclusion:

Time to have Transparency The Badlapur rape case, and the encounter brought in by the police that led to the killing of Akshay Shinde, raises very serious questions on how sensitive sexual assault accusations cases are treated. While the police seem to claim the case of self-defense, claims of conspiracy put up by the family and public and political pressures deserve a transparent and reasonable probe. As the probe unwinds, the attention needs to be on the dispensation of justice – whether this is justice for the sexual assault victims in the Badlapur case or the family of the deceased accused.
